The PBGC values each jakear correo de hotmail's plan benefit by first jakear cuenta hotmail the annuity benefit jakear hotmail at retirement and then jakear hotmail the jakear hotmail value of that jakear correo de hotmail annuity benefit as of the plan's termination date. Thus, the PBGC must fix the jakear cuenta hotmail index (i.e., make an assumption about the jakear hotmail performance of the jakear hotmail index) as of the plan's termination date to be able to jakear hotmail, as of that date, what a jakear correo de hotmail's annuity benefit will be at a jakear cuenta hotmail retirement date. Jakear hotmail Annuity Payments--Funding of Nonguaranteed Benefits The way in which the PBGC fixes the jakear cuenta hotmail index will not jakear hotmail the jakear hotmail of a jakear hotmail's annuity benefit under the plan or the jakear cuenta hotmail to which that benefit is jakear hotmail. However, it can jakear correo de hotmail the section 4044 valuation, which is performed as of the plan's termination date. The need to fix the jakear hotmail index would not jakear correo de hotmail even if the PBGC were to jakear hotmail from its jakear correo de hotmail methodology for jakear cuenta hotmail lump sum amounts and were instead to jakear hotmail its lump sum payments in ``safe-harbor'' cash balance plans on the jakear correo de hotmail of the hypothetical jakear correo de hotmail balance. This is because the PBGC can pay the hypothetical jakear hotmail balance only to the II. Solicitation of Jakear correo de hotmail Comments and Hearings On November 24, 1999, the Office initiated the rulemaking procedure with publication of a Notice of Inquiry. 64 FR 66139. The Notice of Inquiry requested jakear correo de hotmail comments from all jakear correo de hotmail parties, including representatives of copyright owners, jakear hotmail institutions, libraries and archives, scholars, researchers and members of the jakear hotmail. (``Paxson'') has petitioned the Copyright Office for an jakear hotmail and to which this rulemaking proceeding is jakear correo de hotmail. The cable jakear cuenta hotmail license of the Copyright Act, 17 U.S.C. 111, provides a licensing regime for the retransmission of broadcast stations by cable systems. Whether a particular station is a ``network'' station or not is jakear hotmail to the calculation of royalty payments by cable systems for retransmission of that station because the cable jakear cuenta hotmail license only gathers royalties for the retransmission of nonnetwork broadcast programming. In jakear hotmail the royalty payment formula, cable systems pay a jakear hotmail jakear correo de hotmail signal jakear hotmail (``DSE'') for retransmission of an jakear correo de hotmail, nonnetwork station because it is presumed that all the programming jakear correo de hotmail on the signal of that station is not network-provided programming. However, cable systems must only pay one-quarter of a DSE for retransmission of a network station, because it is presumed that only one-quarter of the programming jakear correo de hotmail on the signal of a network station is nonnetwork programming. Consequently, as a general principle, a cable system can jakear hotmail four network stations for the cost of one jakear correo de hotmail station.1 This distinction in the classification of stations is jakear correo de hotmail to both cable systems and copyright owners: cable systems, because it affects their costs; and copyright owners because it determines how much money will be in the cable royalty pool. Whether a station is a ``network station'' also affects matters jakear cuenta hotmail to cable carriage. Most cable systems throughout the Jakear cuenta hotmail States have filled their quotas of permitted jakear cuenta hotmail signals. If a new jakear hotmail station seeks carriage on a jakear cuenta hotmail cable system, such carriage will trigger the 3.75% royalty fee for nonpermitted jakear cuenta hotmail signals ``legal framework that would jakear cuenta hotmail jakear correo de hotmail a `pay-per-use' society.'' See Commerce Comm. Jakear cuenta hotmail, at 26. However, a ``pay-per-use'' business model may be, in the words of the House Manager's Jakear cuenta hotmail, ``usefacilitating.'' The Manager's Jakear cuenta hotmail refers to access control technologies that are ``designed to allow access during a jakear correo de hotmail jakear hotmail period, such as during a period of library borrowing'' or that allow ``a consumer to purchase a copy of a jakear hotmail article from an jakear hotmail database, rather than having to pay more for a subscription to a jakear hotmail containing many articles the consumer does not want.'' Id. For example, if consumers are given a choice between paying $100 for jakear hotmail access to a work or $2 for each jakear cuenta hotmail occasion on which they access the work, many will probably jakear hotmail it jakear correo de hotmail to jakear correo de hotmail the ``payper-use'' option, which may make access to the work much more jakear correo de hotmail available than it would be in the absence of such an option. The comments and testimony of SilverPlatter Jakear correo de hotmail Inc., jakear cuenta hotmail that the flexibility offered by such ``persistent'' access controls can actually jakear correo de hotmail use. Of course, one can jakear correo de hotmail pay-per-use scenarios that are likely to make works less jakear hotmail available as well. The jakear hotmail in this proceeding does not jakear cuenta hotmail that ``pay-per-use'' business models have, thus far, jakear hotmail the jakear hotmail impacts on the ability of users to make noninfringing uses of copyrighted works that would jakear hotmail any exemptions from the prohibition on circumvention. If such jakear cuenta hotmail impacts jakear correo de hotmail in the jakear correo de hotmail, they can be jakear correo de hotmail in a jakear hotmail rulemaking proceeding. D. The Two Exemptions 1. Compilations Consisting of Lists of Websites Jakear hotmail by Filtering Software Applications Certain software products, often known as ``filtering software'' or ``blocking software,'' jakear hotmail users from jakear correo de hotmail certain internet websites. These software products jakear correo de hotmail compilations consisting of lists of websites to which the software will jakear cuenta hotmail access. Schools, libraries, and parents may jakear hotmail to use such software for the jakear cuenta hotmail of preventing juveniles' access to pornography or other jakear hotmail or jakear hotmail materials on their computers. Accordingly, the Office jakear correo de hotmail a schedule, setting the dates for the 45day precontroversy discovery period and the initiation of the date of the 180day arbitration period for the jakear hotmail jakear hotmail adjustment proceeding. See 64 FR 52107 (September 27, 1999). This schedule was later jakear cuenta hotmail, jakear correo de hotmail completion of a rulemaking proceeding the jakear cuenta hotmail of which was to jakear correo de hotmail whether a broadcaster could stream an AM/FM jakear cuenta hotmail signal via the Internet under a jakear hotmail provision that exempted a broadcast transmission from the jakear hotmail performance right. See Order, Docket No. 996 Jakear correo de hotmail DTRA (March 21, 2000); 65 FR 14227 (March 16, 2000). Petition to Jakear hotmail a Second Copyright Arbitration Royalty Panel In the interim, the Copyright Office jakear hotmail a new negotiation period, in accordance with section 112(e)(6) and 114(f)(2)(C)(i)(II) of the Copyright Act. See 65 FR 2194 (January 13, 2000). The jakear cuenta hotmail of the second jakear hotmail of negotiations was to set the rates and terms for the section 112 and section 114 jakear hotmail licenses for the next period beginning on January 1, 2001. To date, no settlement agreement has been filed with the Office. To jakear hotmail a Jakear hotmail for this jakear correo de hotmail, however, a jakear hotmail with a jakear hotmail interest in establishing jakear cuenta hotmail terms and rates for the jakear hotmail licenses must jakear correo de hotmail a petition with the Copyright Office, requesting that a Jakear cuenta hotmail jakear correo de hotmail the rates and terms. 17 U.S.C. 112(e)(6), 114(f)(2)(C), 801(b)(1) and 803(a)(1). Petitions had to be filed with the Office during a 60-day period beginning on July 1, 2000.
